Terms and Conditions of Udesign Tutor

These Terms and Conditions (“Agreement”) govern the use of the tutoring services provided by Udesign Tutor (“Company”) to the users (“Students” or “Users”) of the services. By using the services of Udesign Tutorou agree to comply with and be bound by the following terms and conditions:

  1. Tutoring Services: a. Udesign Tutor provides online tutoring services to Students in the United Kingdom. b. Tutoring services are provided by qualified tutors who possess the necessary knowledge and expertise in the subjects they teach. c. The Company reserves the right to assign a tutor based on availability and expertise.
  2. Registration and User Account: a. Students must create a user account on the Udesign Tutor platform to access the tutoring services. b. Students must provide accurate and up-to-date information during the registration process. c. Students are responsible for maintaining the confidentiality of their account login credentials and for any activities that occur under their account. d. Students must notify Udesign Tutor immediately if they suspect any unauthorized use of their account.
  3. Payment: a. The cost of tutoring services will be communicated to Students before the commencement of tutoring sessions. b. Students must make the payment for tutoring services in advance, using the payment methods provided by Udesign Tutor. c. All payments are non-refundable, except as explicitly stated in the Refund Policy.
  4. Scheduling and Cancellation: a. Tutoring sessions are scheduled based on mutual agreement between the Student and the assigned tutor. b. Students must provide a minimum notice period of 24 hours for any cancellation or rescheduling of tutoring sessions. c. In case of a no-show or failure to provide the minimum notice period for cancellation or rescheduling, the session may be considered forfeited, and no refund will be provided.
  5. Code of Conduct: a. Students are expected to behave respectfully and professionally during tutoring sessions. b. Students must not engage in any form of abusive, offensive, or discriminatory behavior towards tutors or other Users. c. Students must not share any inappropriate or illegal content during tutoring sessions. d. Udesign Tutor reserves the right to terminate tutoring services if a Student violates the code of conduct.
  6. Intellectual Property: a. All intellectual property rights, including copyrights, patents, and trademarks, related to the tutoring materials provided by Udesign Tutor, are the property of the Company. b. Students may use the tutoring materials solely for personal educational purposes and may not reproduce, distribute, or modify them without prior written consent from Udesign Tutor.
  7. Limitation of Liability: a. Udesign Tutor will make reasonable efforts to provide high-quality tutoring services but does not guarantee specific outcomes or improvements in the Student’s performance. b. The Company shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages arising out of the use or inability to use the tutoring services.
  8. Modification and Termination: a. Udesign Tutor reserves the right to modify or terminate the tutoring services or any part thereof without prior notice. b. The Company may terminate a Student’s access to the services if they violate these Terms and Conditions or engage in any unlawful or harmful activities.
  9. Governing Law and Jurisdiction: a. These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom. b. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
  10. Entire Agreement: These Terms and Conditions constitute the entire agreement between the Student and Udesign Tutor and supersede any prior agreements or understandings, whether written or verbal.

Refund Policy:

  1. Refund Eligibility: a. Refunds may be granted under the following circumstances: i. If Udesign Tutor fails to provide the agreed-upon tutoring services due to tutor unavailability or technical difficulties. ii. If the Student cancels a prepaid tutoring session within the minimum notice period of 24 hours. iii. If the Student is not satisfied with the quality of the tutoring session and provides valid reasons for the dissatisfaction.
  2. Refund Process: a. To request a refund, the Student must contact Udesign Tutor’s customer support within a reasonable timeframe, providing relevant details and supporting documentation if required. b. Refunds, if approved, will be processed within a reasonable timeframe using the same payment method used for the initial payment, unless otherwise agreed upon.
  3. Non-Refundable Circumstances: a. No refunds will be provided in the following circumstances: i. If the Student fails to attend a scheduled tutoring session without providing the minimum notice period of 24 hours. ii. If the Student violates the Code of Conduct and their access to the tutoring services is terminated. iii. If the Student has already utilized the tutoring services and later requests a refund without valid reasons.
  4. Partial Refunds: a. In some cases, partial refunds may be granted based on the unused portion of the prepaid tutoring sessions.
  5. Discretion of Udesign Tutor: a. Udesign Tutor reserves the right to evaluate refund requests on a case-by-case basis and exercise discretion in determining refund eligibility.
  6. A tutorial can be cancelled any time up to 24 hours before it starts. After this we will not be able to offer a refund. Discussing cancellation with the tutor or parent does not suffice for a refund, cancellations have to be done within your dashboard.

Please note that this Refund Policy is subject to Udesign Tutor Terms and Conditions, and any refund granted shall not exceed the total amount paid by the Student for the tutoring services.

Non-poaching agreement

  1. Non-Poaching Agreement: 1.1 Tutors acknowledge and agree that the Company invests substantial resources in acquiring and maintaining a client base. To protect the Company’s legitimate business interests, Tutors shall not directly solicit or accept tutoring services from any client of the Company, either during the tenure of their engagement with the Company or for a period of [insert duration, e.g., 12 months] after the termination of their engagement. 1.2 Tutors shall not engage in any form of direct communication or contact with clients of the Company for the purpose of soliciting or offering tutoring services, including but not limited to phone calls, emails, in-person meetings, or through social media platforms. 1.3 In the event that a client of the Company approaches a Tutor directly with an intention to discontinue services with the Company, the Tutor must promptly notify the Company of such contact and shall not enter into any tutoring arrangement with the client without the prior written consent of the Company. 1.4 Tutors acknowledge that any breach of this non-poaching agreement may result in legal action by the Company to seek injunctive relief, damages, or any other appropriate remedies available under applicable laws.
  2. Confidentiality and Non-Disclosure: 2.1 Tutors agree to maintain the confidentiality of all client information obtained during their engagement with the Company, including but not limited to client contact details, academic performance, and personal information. 2.2 Tutors shall not disclose, share, or use any client information for any purposes other than the provision of tutoring services through the Company. 2.3 The obligations of confidentiality and non-disclosure shall survive the termination of the Tutor’s engagement with the Company.
  3. Intellectual Property: 3.1 Tutors understand and agree that all intellectual property, including but not limited to lesson plans, teaching materials, and proprietary content provided by the Company, remain the exclusive property of the Company. 3.2 Tutors shall not reproduce, distribute, or use any of the Company’s intellectual property outside the scope of providing tutoring services on behalf of the Company.
  4. Termination: 4.1 The Company reserves the right to terminate a Tutor’s engagement at any time and for any reason, including a violation of the terms of this Agreement. 4.2 Upon termination, Tutors shall immediately cease any engagement with the Company’s clients and shall return or destroy any confidential or proprietary information obtained during their engagement.
